Виза в Австрию

Уважаемые заявители.

В 2007 году между Российской Федерацией и Европейским сообществом вступило в действие Соглашение между Европейским сообществом и Российской Федерацией об упрощении выдачи виз гражданам Европейского Союза и Российской Федерации;

25 февраля 2022 г. было принято Решение Совета (ЕС) 2022/333 о частичном приостановлении применения Соглашения между Европейским сообществом и Российской Федерацией об упрощении выдачи виз гражданам Европейского Союза и Российской Федерации;

06 сентября 2022 г. принято Решение Совета Европы о полном приостановлении применения Соглашения между Европейским сообществом и Российской Федерацией об упрощении выдачи виз гражданам Российской Федерации;

09 сентября 2022 г. Сообщением Европейской Комиссии установлены общие рекомендаций по выдаче виз в отношении российских заявителей;

09 сентября 2022 г. в пресс релизе Европейской Комиссии на русском языке обобщены и конкретизированы общие Рекомендации по более строгому оформлению виз для граждан России по факту полной приостановки Соглашения между Европейским сообществом и Российской̆ Федерацией̆ об упрощении выдачи виз гражданам Европейского Союза и Российской̆ Федерации.

Ни в одном из принятых решений и выработанных рекомендаций не установлено строгих критериев определяющих порядок рассмотрения заявлений о выдаче визы.

Формально приостановка Соглашения об упрощении выдачи виз должна привести к возвращению к применению ранее заключенных двусторонних Консульских Конвенций и Соглашений между странами Европы и применению Общей консульской инструкции 1999 года, однако, в настоящее время к рассмотрению заявлений граждан России о выдаче виз не применяется ни одно соглашение.

При рассмотрении заявлений о выдаче виз гражданам России применяются внутренние регламенты стран, а большинстве случаев правила и требования определяются конкретным консульским учреждением руководствуясь общими рекомендациями, а именно: 

- менее оперативная обработка заявлений лиц, у которых нет срочной причины для поездки;

- более длительное время обработки заявлений;

- затребование дополнительных документов;

- более строгое рассмотрение заявлений о выдаче виз;

- более тщательная проверка заявителей на предмет потенциальной угрозы общественному порядку, внутренней безопасности или международным отношениям государства-члена ЕС;

- отказ в выдаче визы в случае сомнений в намерении заявителя покинуть территорию ЕС по истечении срока действия визы; 

- строгий подход при повторной оценке действительных краткосрочных виз, уже выданных гражданам России, и возможное аннулирование имеющихся виз

- принципиальный отказ от выдачи многократных виз с длительным сроком действия, вместо этого выдача однократных виз и/или виз с более коротким сроком действия.

При этом,  ЕС занимает открытую позицию по отношению к российским заявителям на получение виз, совершающим поездки по срочным причинам, в частности, для членов семей граждан ЕС, журналистов, диссидентов и представителей гражданского общества. Указанные директивы призваны стимулировать государства-членов ЕС использовать в таких случаях имеющиеся возможности. Например, в соответствии с визовыми правилами государства-члены ЕС могут принять решение об уменьшении или отмене визового сбора в определённых случаях, что может облегчить поездки для журналистов, диссидентов, школьников, студентов и исследователей.

В связи с вышеизложенной официальной позицией ЕС в отношении заявлений российских граждан, основное значение приобрела приминительная практика по каждой конкретной стране, которая в большинстве содержит не официальные требования и процедуры при подаче заявлений на визу. Однако, в части принятия решений в отношении каждого заявителя каждое конкретное консульство руководствуется внутренним убеждением о возможности или невозможности в выдаче визы. Просим вас с пониманием отнестись к сложившейся ситуации.

В настоящее время мы вынуждены руководствоваться предыдущими требованиями консульских учреждений выработанными за последние 15 лет.

Гражданам России и СНГ для въезда в Австрию необходима виза.

Без визы, на территории стран-участниц Шенгенского соглашения, могут находиться граждане Грузии, Молдавии и Украины до 90 дней в течение каждых 180 дней.

Австрия является членом Шенгенской конвенции.

Шенгенская виза действует в следующих странах:
Австрия, Бельгия, Венгрия, Германия, Греция, Дания, Исландия, Испания, Италия, Латвия, Литва, Лихтенштейн, Люксембург, Мальта, Нидерланды, Норвегия, Польша, Португалия, Словакия, Словения, Финляндия, Франция, Чешская Республика, Швеция, Швейцария и Эстония.

ТИПЫ ВИЗ

Аэропортная транзитная виза (А) требуется гражданам определенных стран, которые пересекают международные транзитные зоны аэропортов, фактически не въезжая на территорию соответствующей страны, во время остановки или пересадки в аэропорту между двумя этапами международного перелета. Такая виза является исключением из общего правила, предусматривающего право на безвизовое пересечение международной транзитной зоны.

Краткосрочная виза (тип С) – это виза на временное пребывание на территории того или иного государства, но не более 90 дней за период 180 дней. Виза может быть однократной, двукратной и многократной и позволяет иностранцу, в течение указанного в визе времени, пересечь транзитом или въехать и планировано находиться на территории стран – участниц Шенгенского договора. Период действия визы может быть от нескольких дней (как правило выдается по срокам поездки) до нескольких лет, однако продолжительность поездки либо суммарное количество дней пребывания на территории стран Шенгенского Соглашения не должно превышать 90 дней за каждый период 180 дней.

Национальная виза (D) требуется гражданам, которые планируют жить на территории того или иного государства, в течение более чем 90 дней, но не более, чем 6 месяцев (студенческий обмен, краткосрочное обучение) в течение одного года, но не являются гражданином ЕС или Европейской ассоциации свободной торговли (EFTA).

Туристическая виза в Австрию
Необходимые документы:
-загранпаспорт, действительный не менее 3 месяцев с момента выезда из Шенгенского пространства и имеющий как минимум две свободные страницы;

-копия первой страницы загранпаспорта;
-аннулированный паспорт, если имеется;
-копии шенгенских виз за последние 3 года из предыдущих (аннулированных)/ действующих загранпаспортов;
-анкета, заполненная на немецком или английском языке;
-2 цветные фотографии 35х45 мм.;
-копии страниц c отметками внутреннего паспорта;
-медицинская страховка (сумма страхования - не менее 30 000 евро);



-приглашение принимающей стороны;
-обратные билеты;
-финансовые документы.
Для работающих:

• Справка с места работы.
• Подтверждение наличия достаточных денежных средств.

Для индивидуальных предпринимателей:

• Справка о регистрации фирмы.  
  
• Актуальная выписка из банковского счета фирмы не позднее трех месяцев со дня получения.
  
• Выписка из налогового реестра.  

Для несовершеннолетних или учащихся:

• Справка со школы, учебного заведения.
  
• Спонсорское письмо с ксерокопией общегражданского паспорта спонсора.
  
• Справка с работы с указанием должности и оклада спонсора.
  
• Актуальная выписка из банковского счета не позднее трех месяцев со дня получения.

Для пенсионеров:

• Пенсионное удостоверение, (оригинал, копия).
  
• Актуальная выписка из банковского счета не позднее трех месяцев со дня получения.
  ИЛИ 
  
• Спонсорское письмо с ксерокопией общегражданского паспорта спонсора.
  
• Справка с работы с указанием должности и оклада спонсора.
  
• Актуальная выписка из банковского счета спонсора не позднее трех месяцев со дня получения.

Перевод документов
Необходимо предоставить переводы всех русскоязычных документов. Каждый переведенный документ должен соответствовать следующим требованиям:

• Подтверждение того, что перевод был выполнен в точности с оригинального документа;
• Дата перевода;
• Фамилия Имя Отчество переводчика, а также его подпись;
• Контактную информацию о переводчике/компании.

При въезде на территорию страны на личном автомобиле, помимо указанных выше документов, необходимо иметь при себе водительское удостоверение, техпаспорт и международный полис обязательного страхования гражданской ответственности владельцев транспортных средств — Green Card. Также рекомендуется составить маршрутный лист.

Близкие родственники, посещающие российских граждан, законно проживающих на территории страны-члена Шенгенской зоны
Необходимые документы:
-загранпаспорт, действительный не менее 3 месяцев с момента выезда из Шенгенского пространства и имеющий как минимум две свободные страницы;

-копия первой страницы загранпаспорта;
-аннулированный паспорт, если имеется;
-копии шенгенских виз за последние 3 года из предыдущих (аннулированных)/ действующих загранпаспортов;
-анкета, заполненная на немецком или английском языке;
-2 цветные фотографии 35х45 мм.;
-копии страниц c отметками внутреннего паспорта;
-медицинская страховка (сумма страхования - не менее 30 000 евро);



-письменный запрос от принимающего лица, чья подлинная подпись должна быть заверена компетентным австрийским органом;
-подтверждение легального проживания приглашающего лица и семейных связей в соответствии с законодательством страны-члена Шенгенской зоны;
-финансовые документы.
Для работающих:

• Справка с места работы.
• Подтверждение наличия достаточных денежных средств.

Для индивидуальных предпринимателей:

• Справка о регистрации фирмы.  
  
• Актуальная выписка из банковского счета фирмы не позднее трех месяцев со дня получения.
  
• Выписка из налогового реестра.

-аннулированный паспорт, если имеется;

-анкета, заполненная на немецком или английском языке;

-подтверждение семейных связей в соответствии с законодательством страны- члена Шенгенской зоны, являющейся страной проживания, и ЕС.

-копия первой страницы загранпаспорта;
-аннулированный паспорт, если имеется;

-анкета, заполненная на немецком или английском языке;
-2 цветные фотографии 35х45 мм.;
-копии страниц c отметками внутреннего паспорта;

-письменный запрос от принимающей организации (компетентного органа, национальной спортивной федерации или национального Олимпийского комитета), включающий информацию о роли данных лиц в мероприятии;
-заявление о спонсорстве от отправляющей или от принимающей стороны, если таковое не было включено в запрос (или другое подтверждение наличия финансовых средств).

-письмо (например, вербальная нота) выданное компетентным Российским органом (например, МИД), подтверждающее, что заявитель является членом делегации, направляющейся в Австрию.

Виза для посещения воинских или гражданских захоронений в Австрии
Необходимые документы:

-письменный запрос от Ассоциации Международных Автомобильных Перевозчиков (АСМАП) или Российского автотранспортного союза (РАС).

-письмо от работодателя, подтверждающее, что цель поездки заключается в проведении журналистской работы.  

Журналистам-фрилансерам необходимо предоставить:
-подтверждение осуществления журналистской деятельности (к примеру, корреспондентское удостоверение или рабочий контракт);
-подтверждение наличия достаточных денежных средств.

ДОЛГОСРОЧНАЯ ВИЗА / НАЦИОНАЛЬНАЯ ВИЗА ТИПА D

Если Вы планируете жить в Австрии в течение более чем 90 дней, но не более, чем шесть месяцев (студенческий обмен, краткосрочное обучение) в течение одного года, но Вы не являетесь гражданином ЕС или Европейской ассоциации свободной торговли (EFTA), Вам понадобится национальная австрийская виза (Виза D). 

В соответствии с Шенгенским визовым кодексом, лицо, получившее национальную визу, выданную Австрией или другой страной Шенгенской зоны, имеет право совершать поездки в другие страны Шенгенской зоны на срок не более 90 дней в течение периода до 6 месяцев (т.е. в течение максимального срока действия австрийской визы D).

Temporary residence

First Applications
As a matter of principle, first applications for a residence title shall be filed abroad and in person, before entering Austria.

The application must give a detailed indication of the residence purpose. 

Inadmissible: filing an application covering several residence purposes, filing several applications simultaneously and filing additional applications while proceedings are still pending.

Evidence of qualifications required has to be provided.

Certain groups of persons may also file first applications in Austria:

• Family members of Austrian nationals after lawful entry and during lawful residence, 
• Foreign citizens within six months after the end of their lawful settlement in Austria, if they were previously not required to hold a residence permit according to the provisions of the Settlement and Residence Act,
• Foreign citizens within six months after loss of their Austrian, Swiss or EEA citicenship,
• Children within six months after birth, if their mother holds a valid residence title,
• Foreign citizens entitled to enter without a visa, during their permitted stay without a visa,
• Foreign citizens applying for a residence permit as a researcher and their family members, 
• Holders of a job search visa (Section 24a, Aliens Police Act) applying for a “Red-White-Red Card” pursuant to Section 41(1) of the Settlement and Residence Act (i.e. as “highly qualified specialist”) and
• Graduates from an Austrian university applying for a “Red-White-Red Card” while lawfully residing in Austria with a certificate under Section 64(4) of the Settlement and Residence Act.

NOTE: An application filed in Austria shall not grant a right of residence to the applicant beyond the time he/she is allowed to stay with or without visa. When the time allowed to stay with or without visa has expired he/she is required to depart and must await proceedings abroad.

General Granting Requirements
The following requirements must be fulfilled for any residence title to be granted:

Adequate means of subsistence 
The applicant must have fixed and regular own income enabling him/her to cover his/her living costs without resorting to welfare aid from local authorities. At the time of application the regular monthly income must be equal to the amount of the standard rates of the General Social Insurance Act (ASVG).

• For singles: €889.84
• For couples: €1,334.17
• For each child additionally €137.30

Health Insurance Coverage
The applicant must have health insurance coverage providing benefits in Austria. 

Adequate accommodation according to local standards 
The applicant must provide evidence of a legal title to an accommodation (e.g. by providing a lease contract), considered adequate for his/her family size according to local standards.

Granting Obstacles
Residence permits may not be granted to an alien if 

• an upright entry ban according to § 53 FPG was ordered against him or a valid residence prohibition according to § 67 FPG exists;
• a return decision of another EEA state or Switzerland exists against him;
• an return decision was ordered agains thim and 18 months have not yet passed since his depature, provided that he has not submitted his application according to § 21 Abs. 1 NAG, after he fulfiled his depature obligation voluntarily;
• a marriage, registered partnership or adoption for purposes of residence (§ 30 Abs. 1 or 2 NAG) exists;
• the duration of a permissible visa free or visa required stay in the context of § 21 Abs. 6 NAG has been exceeded, or
• he was fined legally binding for evading border checks or for entering federal territory illegally during the past twelve months."

Residence Permits

Rotational employee
Austrian Public Employment Service (Arbeitsmarktservice, AMS) approval required: confirmation of employment or employment permit as rotational employee; no AMS approval required in the case of Section 18(3), clause 2 of the Act Governing the Employment of Foreign Nationals

Seconded employee 
AMS approval required: confirmation of employment or employment permit as seconded employee; employment longer than six months

Self-employed person 
if the foreign citizen has contracted to perform certain services and the contract covers a period of more than six months; AMS may be involved

Artists
self-employed or employed; activity is predominantly of an artistic nature and the income earned covers their livelihood; a liability declaration is permissible; when employed: AMS approval required: confirmation of employment or employment permit as artist

Specific cases of gainful employment
if such employment is exempted from the Act Governing the Employment of Foreign Nationals; explanation of exemption circumstances required

Researchers 
having a hosting agreement with a certified research facility 

Students

• For regular and extraordinary studies at a public university, a polytechnic institute, an accredited private university, a public or an accredited teachers college, an accredited private study programme or an accredited private university course (University Act 2005)
• For university courses not intended exclusively for teaching a language
• Liability declaration permissible 
• For extensions: evidence of study success is necessary 

NOTE: Any gainful employment shall be governed by the provisions of the Act Governing the Employment of Foreign Nationals. Such employment must not interfere with the studies, for that matter.

Pupils

• regular pupils attending a
  - Public school
  - Private school under public law
  - Statutory school under public law
  - Certified non-academic educational institution 

• extraordinary pupils at a public school or private school under public law, in case a first residence permit is issued 
• Regular “Students” attending a public or private adult educational institution under public law 
• Liability declaration permissible 
• Extensions:
  - Evidence of study success is necessary
  - Extraordinary status of the pupil must be changed to regular status

NOTE: Any gainful employment shall be governed by the provisions of the Act Governing the Employment of Foreign Nationals. Such employment must not interfere with the studies.

Social Service Employee

• Maximum validity 1 year  (no extension possible)
• If the social service is not subject to the Act Governing the Employment of Foreign Nationals and is provided by a non-partisan and charitable non-profit organisation 
• If the services are not provided for pecuniary gain 
• A liability declaration from the sponsor organisation the social service employee is working for must be provided

Family Community

• Only spouses, registered partners or unmarried minors including adoptive and step children (spouses and registered partners must be 21 years of age or older when applying) of sponsors holding the following residence permits:
  - Rotational employee
  - Artist
  - Special cases of gainful employment
  - Student
  - Researcher

• Family reunification with sponsors of the following residence permits is not possible:
  - Pupil 
  - Self-employed person
  - Social Service Employee
  - Seconded employee

Permanent immigration - Red-White-Red Card

Criteria-based Immigration to Austria
Austria has a flexible immigration scheme: the Red-White-Red Card. It aims to facilitate the immigration of qualified third-country workers and their families with a view to permanent settlement in Austria, based on personal and labour-market related criteria. 

The related set of rules entered into force on 1 July 2011. 

Red-White-Red Card
The Red-White-Red Card is issued for a period of twelve months and entitles the holder to fixed-term settlement and employment by a specified employer. 

The following persons are eligible for a Red-White-Red Card:

• very highly qualified workers
• skilled workers in shortage occupations
• other key workers 
• graduates of Austrian universities and colleges of higher education
• self-employed key workers

Where to file the application?
Visas for the purpose of job search have to be applied for at the competent Austrian representation (embassy, consulate) of the applicants home countries or countries of residence. Application forms are available at the Austrian representation. Visas for the purpose of job search will be granted if the Public Employment Service (AMS) confirms to the Austrian representation that the required points for admission have been reached.

Very highly qualified workers who have obtained a job search visa may apply for a Red-White-Red Card with the competent residence authority in Austria if they are able to submit an employment offer (work contract) during the period of validity of the visa. The competent authority can either be the Provincial Governor (Landeshauptmann), the authorised Regional Administrative Authority (Bezirkshauptmannschaft) or the Local Administrative Authority (Magistrat).

Applicants permitted to enter Austria under a visa-free regime do not require a Jobseeker Visa. They may apply for the Red-White-Red Card during their lawful visa-free stay in Austria if they find a job corresponding to their qualifications during this period.

Further, Red-White-Red Card applications for "very highly qualified workers" can be filed personally with the Austrian representation (embassy or consulate) for the applicants country of residence or by the potential employer with the competent residence authority in Austria which can be  the Provincial Governor (Landeshauptmann), the authorised Regional Administrative Authority (Bezirkshauptmannschaft) or Local Administrative Authority (Magistrat). An employers declaration (Arbeitgebererklärung) has to be submitted along with the application.

PLEASE NOTE: If you want to make use of a representative in your legal procedure, please make sure that your Austrian representative is legally authorized. Otherwise your representative cannot be accepted by the Austrian authorities.

Which documents to submit?
The following documents must be submitted upon application for the Jobseeker Visa:

• Evidence of adequate means of subsistence (payslips, pay certificates, employment contracts, insurance benefit certificates, evidence of retirement or other pension or insurance benefits, investment capital or sufficient own assets)

1. Special qualifications and skills
Graduation

• Document furnishing proof of successful completion of a four-year programme at a university or another institution of tertiary education
• Document reflecting the status of the university or other institution of tertiary education
• Document furnishing proof of successful completion of a programme in a MINT subject (= mathematics, informatics, natural sciences, technology)
• Document furnishing proof of habilitation

Gross annual salary in a senior management position

• Tax assessment notice or pay certificate
• Confirmation by the previous employer that the applicant worked in a senior management position
• Proof that the company is listed on the stock exchange or positive report from the Austrian foreign trade office in charge about its activities or business segment

Research and innovation activities

• Proof of scientific publications, stating titles and sources
• Certificate issued by a university or research institution that the applicant worked in R&D or academic scientific teaching
• Proof of patent application(s) through extracts from national or regional patent registers

Recognised awards and prizes

• Document proving the conferral of the award or prize

3. Language skills

• Language diploma or language course certificate at the A1 or A2 levels of the Common European Framework of Reference for Languages.
  German language diplomas and certificates may in particular be obtained from the following institutions: ÖSD, Goethe-Institut, Telc GmbH, Austrian Integration Fund (ÖIF)
.
  The following diplomas and certificates are in particular recognised as evidence of proficiency in English: Cambridge Certificate, TELC, IELTS diploma, TOEIC diploma, TOEFL diploma.

4. Studies in Austria

• Course record book and related examination certificates
• Document reflecting the successful completion of a programme of studies in Austria

PLEASE NOTE: Originals and copies of the above-mentioned documents must be submitted. If the documents are not available in German or English, translations into German or English must be provided. The Austrian representation will examine documents for completeness and send them to the Public Employment Service for assessment and awarding of points. Upon request by the AMS certified versions of documents must be furnished.

When will a Red-White-Red Card be issued?
The Red-White-Red Card is issued after examination by the Public Employment Service (AMS), provided that the intended employment corresponds to the applicants qualifications, is adequately paid and the general requirements under settlement and residence legislation are met (such as locally customary accommodation, health insurance coverage etc.).

The Red-White-Red Card entitles the holder to fixed-term settlement and employment by a specified employer.

When will a Red-White-Red Card plus be issued?
Very highly qualified persons who hold a Red-White-Red Card may apply for a Red-White-Red Card plus at the competent residence authority in Austria (Provincial Governor, authorised Regional Administrative Authority or Local Administrative Authority) if they were employed in accordance with the criteria decisive for eligibility for a minimum of ten months during the preceding twelve months.

The Red-White-Red Card plus entitles the holder to fixed-term settlement and unlimited labour market access.

Skilled workers in shortage occupations
Third-country citizens may apply for a Red-White-Red Card as a skilled worker in a shortage occupation valid for twelve months, if

• they are able to furnish proof of completed training in a shortage occupation under the regulation 
• they have received a binding job offer in Austria and the prospective employer is willing to remunerate them with the minimum pay stipulated by law, regulation or collective agreement (in the event that overpay is customary in the respective undertaking, it must also be granted to the applicant)

Which professions are deemed shortage occupations?
Shortage occupations are promulgated each year in a regulation (Fachkräfteverordnung) issued by the Federal Minister of Labour in consultation with the Federal Minister of Economics. Which occupations are considered as shortage occupations depends on the development of the Austrian labour market.

For the year 2017, the following occupations are deemed shortage professions: 

• 1. Milling machinists
• 2. Technicians with a higher level of training (Engineer) for mechanical engineering
• 3. Black toppers
• 4. Metal turners
• 5. Technicians with a higher level of training (Engineer) for data processing
• 6. Technicians with a higher level of training (Engineer) for power engineering technology
• 7. Graduate engineers in mechanical engineering
• 8. Roofers
• 9. (Speciality) power engineers
• 10. Graduate engineers for data processing
• 11. Graduate nurses who started with their complementary training in Austria until the end of 2016 and have completed it at the time of application. Persons who have not yet received the relevant nostrification decision by the Austrian authorities are not covered.

PLEASE NOTE: Originals and copies of the above-mentioned documents must be submitted. If the documents are not available in German or English, translations into German or English must be provided at the request of the Austrian representation or the Public Employment Service (AMS); possibly, certified versions of documents may be required.

When will a Red-White-Red Card be issued?
The Austrian representation or residence authority will send the application and supporting documents to the Public Employment service (AMS). The AMS will examine if the required number of points was reached, if vocational education/training in the shortage occupation was completed and if the worker will be paid adequately.

If all requirements are fulfilled, the AMS will send confirmation to the residence authority and the residence authority will then issue the Red-White-Red Card, provided that the other requirements under settlement and residence legislation are met (such as locally customary accommodation, health insurance coverage etc.).

The Red-White-Red Card entitles the holder to fixed-term settlement and employment by a specified employer.

When will a Red-White-Red Card plus be issued?

Skilled workers in a shortage occupation who hold a Red-White-Red Card may apply for a Red-White-Red Card plus with the competent residence authority in Austria (Provincial Governor, authorised Regional Administrative Authority or Local Administrative Authority) if they were employed in accordance with the criteria decisive for eligibility for a minimum of ten months during the preceding twelve months.

The Red-White-Red Card plus entitles the holder to fixed-term settlement and unlimited labour market access.

Other key workers
Third-country citizens who are to take up employment in undertakings as key workers due to their qualifications, may apply for a Red-White-Red Card valid for twelve months if they fulfil the following requirements:

• The prospective employer will pay the statutory minimum salary: 
  - for key workers over 30 years of age: € 2,988 (2017) gross monthly pay plus special payments (holiday and Christmas pay),
  - for key workers under 30 years of age: € 2,490 (2017) gross monthly pay plus special payments (holiday and Christmas pay) 
• No equally qualified person registered as a jobseeker at the Public Employment Service (AMS) can be placed (labour market test/Arbeitsmarktprüfung).

Where to file the application?
The application for the Red-White-Red Card can either be filed personally with the Austrian representation (embassy or consulate) for the applicants country of residence or by the potential employer with the competent residence authority in Austria, which can be the Provincial Governor (Landeshauptmann), the authorised Regional Administrative Authority (Bezirkshauptmannschaft) or the Local Administrative Authority (Magistrat). An employers declaration (Arbeitgebererklärung) has to be submitted along with the application.

Persons who are permitted to enter Austria under a visa-free regime or already have a valid residence title may also file their applications with the competent residence authority in Austria.

PLEASE NOTE: If you want to make use of a representative in your legal procedure, please make sure that your Austrian representative is legally authorized. Otherwise your representative cannot be accepted by the Austrian authorities.

Which documents to submit?

When will a Red-White-Red Card be issued?
The Austrian representation or residence authority will send the application and supporting documents to the Public Employment Service (AMS). The AMS will examine

• if the required number of points has been reached,
• if the prospective salary conforms with the statutory minimum (see above) and
• if no equally qualified person registered as a jobseeker can be placed.

If all requirements are fulfilled, the AMS will send confirmation to the residence authority and the residence authority will then issue the Red-White-Red Card, provided that the general requirements under settlement and residence legislation are met (such as locally customary accommodation, health insurance coverage etc.).

The Red-White-Red Card entitles the holder to fixed-term settlement and employment by the employer specified in the application.

When will a Red-White-Red Card plus be issued?
Key workers who hold a Red-White-Red Card may apply for a Red-White-Red Card plus with the competent residence authority in Austria (Provincial Governor, authorised Regional Administrative Authority or Local Administrative Authority) if they were employed in accordance with the criteria decisive for eligibility for a minimum of ten months during the preceding twelve months.

The Red-White-Red Card plus entitles the holder to fixed-term settlement and unlimited labour market access. 

Self-employed key workers
Third-country citizens can apply for a Red-White-Red Card for self-employed key workers, if their self-employed occupation in Austria creates macroeconomic benefit going beyond its own operational benefit. 

This may be the case if

• the intended occupation involves a sustained transfer of investment capital to Austria 
• the intended occupation creates new jobs or secures existing jobs in Austria or 
• the settlement of the key worker involves the transfer of know-how respectively the introduction of new technologies or 
• the key workers company is of considerable significance for the entire region. 

For self-employed key workers, there is no points system. 

Where to file the application?
Applications for a Red-White-Red Card must be submitted personally by the applicant, at the competent Austrian representation (embassy or consulate) in the applicants home country, respectively country of residence. 

Persons entitled to visa-free entry to Austria and persons already holding a valid residence title may submit their application directly with the competent residence authority in Austria (Landeshauptmann respectively the authorized Bezirkshauptmannschaft or Magistrat).

Which documents to submit?

• Valid travel document (e.g. passport) 
• Birth certificate or similar document acknowledged by the Austrian authorities 
• Photo (dimensions: 45x35mm) not older than six months 
• Evidence of locally customary accommodation (e.g. lease contracts, preliminary agreement on tenancy rights or ownership evidence) 
• Evidence of health insurance covering all risks (compulsory health insurance or equivalent insurance policy) 
• Evidence of adequate means of subsistence (payslips, pay certificates, employment contracts, insurance benefit certificates, evidence of retirement or other pension or insurance benefits, investment capital or sufficient own assets)
• Documents which allow an analysis and evaluation of the market and competitive situation and the headquarter location, including a detailed description and the objectives of the intended professional undertaking (“business plan“)
  
• Evidence of the transfer of investment capital to Austria and of the intended creation of new jobs or securing of existing jobs in Austria
  
• Evidence of the qualification necessary for the self-employed professional activity
  
• Possibly company agreements and/or
  
• Craft authorisations (Gewerbeberechtigungen), where necessary 

PLEASE NOTE: Originals and copies of all documents and certificates must be presented. The competent authorities may demand English or German translations, if the documents are not in German or English, and they may eventually demand legalized versions of the documents. 

When will a Red-White-Red Card be issued?
The residence authority forwards the application including all submitted documents to the Public Employment Service (Arbeitsmarktservice, AMS). The AMS issues an expertise on the macroeconomic benefit of the intended professional activity within three weeks, especially regarding the transfer of investment capital and the creation and the securing of jobs. 

If the conditions are met, the AMS sends a positive expertise to the residence authority. The residence authority issues a Red-White-Red Card, if all general requirements (such as adequate accommodation according to local standards, health insurance, etc.) are fulfilled. If the application is accepted, the Austrian representation informs the applicant accordingly. Persons who need a visa to enter Austria then have to apply for a visa D in order to get their residence title from the residence authority. 

The Red-White-Red Card is issued for twelve months and entitles its holder to fixed-term settlement and the pursuit of the self-employed occupation as described in the application.

Which residence title will be issued after twelve months?
Self-employed key workers can receive a Red-White-Red Card in the first year, and after that a Niederlassungsbewilligung (settlement permit) if all legal requirements are met. The Niederlassungsbewilligung is issued for twelve months and entitles its holder to fixed-term settlement and the pursuit of the self-employed occupation. 

After a completed total settlement period of two years the settlement permit is issued for three years. 

Can self-employed key workers take-up an employed occupation?
In order to take up an employed occupation self-employed key workers can switch (“Zweckwechsel”) to a Red-White-Red Card for very highly qualified workers, other key workers or skilled workers in shortage professions; in this case, the respective number of required points must be achieved and the applicant must prove a legally binding offer of employment.

EU Blue Card
Third-country nationals may be granted an EU Blue Card, if they 

• have completed a course of study at a university or other tertiary educational institution with a minimum duration of three years, 
• have received a binding job offer for at least one year in Austria and the employment corresponds to the applicants education,
• will earn a gross annual income of at least one and a half times the average gross annual income of full-time employees (in 2017: at least € 59.718 which is about € 4.266 gross monthly income plus special payments), 
• and the labour market test (Arbeitsmarktprüfung) shows that there is no equally qualified worker registered as a jobseeker with the Public Employment Service (AMS) available for the job. 

A points system is not used for the EU Blue Card. 

Where should the application be filed?
Applications for an EU Blue Card may either be filed by the applicant in person with the competent Austrian representation (embassy or consulate) in the applicants home state or country of residence or, on the other hand, by the potential employer with the competent residence authority in Austria (local Provincial Governors Office (Landeshauptmann) or the duly authorised district administration bodies (Bezirkshauptmannschaft or Magistrat)). An employers declaration (Arbeitgebererklärung) has to be submitted along with the application. 

Persons who are entitled to enter Austria without a visa or already have a valid residence title may also file the application themselves with the abovementioned competent residence authority in Austria.

  - divorce certificate
  - certificate of registered partnership
  - certificate of the dissolution of the registered partnership
  - adoption papers
  - evidence or certificate of the family relationship
  - death certificate
• evidence of health insurance (compulsory insurance or a corresponding insurance policy)
• evidence of completion of a course of study at a university or other tertiary educational institution with a minimum duration of three years:
  - certificate of successful graduation
  - proof of the status of the university or other tertiary educational institution.
• employers declaration pursuant to the Act Governing the Employment of Foreign Nationals (AuslBG)

PLEASE NOTE: Originals and copies of the abovementioned documents must be submitted. The authority may request that German or English translations or certified versions of the documents be provided for a thorough examination.

When will an EU Blue Card be issued?
The Austrian representation or residence authority will send the application and supporting documents to the Public Employment Service (AMS). The AMS will examine whether

• a course of study with a minimum duration of three years was completed, 
• the salary conforms to the statutory minimum salary mentioned above, and
• no equally qualified workers registered as jobseekers are available for the position. 

If all requirements are fulfilled, the AMS will send a confirmation to the residence authority, which will consequently issue the EU Blue Card, provided that the other requirements (except for locally customary accommodation and adequate means of subsistence) are met. If the application is granted, the residence authority will inform the applicant. Applicants who need a visa to enter Austria have to apply for a visa D (Visum D) in order to enter Austria and collect the residence title. 

The EU Blue Card entitles the holder to fixed-term settlement and employment with a specific employer. It is issued for a validity of 24 months. 

When will a Red-White-Red Card plus be issued? 
Holders of an EU Blue Card may apply for a Red-White-Red Card plus with the competent residence authority in Austria (Provincial Governor (Landeshauptmann) or the duly authorised district administration bodies (Bezirkshauptmannschaft or Magistrat)), if they were employed in accordance with the criteria decisive for receiving the EU Blue Card for at least 21 months during the preceding 24 months. 

The Public Employment Service (AMS) conducts the examination. The Red-White-Red Card plus entitles the holder to fixed-term settlement and unlimited labour market access (not limited to a specific employer).

Red-White-Red Card plus
The Red-White-Red Card plus entitles third-country nationals to fixed-term settlement and unlimited labour market access (self-employment and gainful employment not limited to a specific employer).

Who is eligible for a Red-White-Red Card plus?
Renewal of the Red-White-Red Card or the EU Blue Card 

• holders of a Red-White-Red Card, if they were employed in accordance with the requirements decisive for receiving the RWR Card for at least ten months within the preceding twelve months
• holders of an EU Blue Card, if they were employed in accordance with the requirements decisive for receiving the EU Blue Card for at least 21 months within the preceding 24 months

Family members

• family members of Red-White-Red Card holders or EU Blue Card holders
• family members of foreign citizens permanently settled in Austria

The following persons are considered family members:

• spouses
• registered same-sex partners
• minor unmarried children, including adoptive and stepchildren (up to the age of 18)

At the time of application, spouses and registered partners must be at least 21 years of age. 

Other cases

• Scientists and researchers who have held the residence title “Residence Permit Researcher” (“Aufenthaltsbewilligung Forscher”) for at least two years.
• Holders of a “Settlement Permit” (“Niederlassungsbewilligung”) or a “Settlement Permit – Dependant” (“Niederlassungsbewilligung – Angehöriger”), provided they
  - have been lawfully settled in Austria for two years and are progressively integrated (have previously been lawfully employed or when – under certain circumstances –  the admission to employment is necessary due to their particular, close social and family ties to Austria), or
  - hold a valid work permit or a valid exemption certificate, or
  - are family members of a third-country national who falls within the scope of item 1. or 2., provided they have been lawfully settled in Austria for twelve months.  
• Persons who previously held the residence title “Permanent Residence – EU”, whose title has expired because of their prolonged residence outside of the EEA.
• Holders of a residence title based on grounds meriting consideration according to the Asylum Act (Asylgesetz) may switch in certain cases. 

Where should the application be filed? 
In case of a first-time application for a residence title (e.g. family members), it should be filed in person and before entry with the competent Austrian representation (embassy or consulate) abroad. 

Applicants who are permitted to enter Austria under a visa-free regime or already hold a valid residence title may also file the application directly with the competent residence authority in Austria (Provincial Governor (Landeshauptmann) or the authorised district administration bodies (Bezirkshauptmannschaft or Magistrat)). 

In case a residence title is renewed, the application should be filed on time, i.e. before the previous residence title expires, but at the earliest three months before that date.

Which documents should be submitted? 

• a valid travel document (e.g. passport)
• a birth certificate or a similar document
• a photo (dimensions: 45x35mm) of the applicant, taken recently (six months ago or less)
• if applicable:
  - marriage certificate or certificate of registered same-sex partnership
  - adoption papers
  - evidence or certificate of the family relationship
• evidence of a legal title to locally customary accommodation (e.g. a lease contract, preliminary agreement on tenancy rights or evidence of ownership)
• evidence of health insurance covering all risks (compulsory health insurance or equivalent insurance policy)
• evidence of adequate means of subsistence (particularly pay slips, proof of earnings, an employment contract, evidence of retirement or other pension or insurance benefits, proof of investment capital or sufficient own assets)

Evidence of social security benefits that may only be claimed after issuance of the residence title, in particular welfare benefits or equalisation supplements, is not suitable.

• family members: evidence that the sponsor holds the required residence title
• if applicable: evidence of German language skills

In individual cases, additional documents may have to be submitted.

PLEASE NOTE: Originals and copies of the abovementioned documents must be submitted. The authorities may request that German or English translations or certified versions of the documents be provided for a thorough examination.

When will a Red-White-Red Card plus be issued? 
The general requirements for the issuance of residence titles as well as the respective particular requirements must be fulfilled. 

In case of a first-time application (family members), evidence of German language skills on A1 level according to the Common European Framework of Reference for Languages must be provided. 

PLEASE NOTE: Family members of holders of a Red-White-Red Card for very highly qualified workers or of an EU Blue Card do not have to provide evidence of German language skills before immigrating to Austria. 

How long is the Red-White-Red Card plus valid? 
The Red-White-Red Card plus is issued for a validity of one year. Persons who have been lawfully settled in Austria for at least two years and who fulfil module 1 of the Integration Agreement can receive a Red-White-Red Card plus valid for three years.

Students and graduates

Pupils and students
The residence permits of pupils and students do not exclude work, unless the primary purpose of stay, i.e. education, is jeopardised.

Employment permit
Pupils and students from third countries as well as from Croatia are subject to the Act Governing the Employment of Foreign Nationals and require an employment permit (Beschäftigungsbewilligung). The application for the permit has to be filed with the Public Employment Service (Arbeitsmarktservice - AMS) by the employer.

Labour market test (Arbeitsmarktprüfung)
Employment permits may be granted with or without a labour market test. Permits will only be granted if the labour market test shows that there is no Austrian worker or no non-Austrian worker (already integrated in the Austrian labour market) registered with the AMS available for the job.

As from 1 July 2011, employment permits may be granted without labour market tests if students are employed

• for up to ten hours per week or
• for up to 20 hours per week, provided that they have completed a Bachelors programme or the first part of a diploma programme.

Employment permits for more than 10 or 20 hours per week respectively can only be granted after the labour market test.

Pupils and students from Croatia will be given unlimited labour market access, to be confirmed by the AMS, after twelve months of continuous employment based on an employment permit.

PLEASE NOTE: After successful completion of a programme of studies in Austria, it is possible for students to switch from "Student Stay Permit" to Red-White-Red Card. Graduates may reside in Austria for a further six months to search for employment if they have obtained confirmation from the competent residence authority.

Graduates from third countries

Residence permit to seek employment
Third-country nationals who have pursued and successfully completed

• 
a Diploma programme (Diplomstudium) at least from the second part onward or 


• 
a Masters programme 



at an Austrian public university, university of applied sciences or accredited private university, may reside in Austria for a further six months for the purpose of searching for employment, provided that they fulfil the general requirements under the Austrian settlement and residence legislation (such as sufficient means of subsistence, locally customary accommodation, health insurance coverage etc.).

Additionally, they need to obtain confirmation from the competent residence authority: Provincial Governor (Landeshauptmann), authorised Regional Administrative Authority (Bezirkshauptmannschaft) or Local Administrative Authority (Magistrat). Such confirmation must be applied for in due time before the residence permit expires.

Red-White-Red Card for graduates
If, within these six months, graduates are able to furnish proof of an employment offer from a specified employer under a work contract which corresponds to their level of qualifications, they will be issued a Red-White-Red Card without labour market test, provided that

• the employer pays the locally customary gross minimum salary which comparable Austrian graduates (junior employees) would receive, but in any case a minimum of € 2.241 (2017) a month, plus special payments (holiday and Christmas pay) and
• they fulfil the general requirements under Austrian settlement and residence legislation (such as locally customary accommodation, health insurance coverage etc.).

This rule does not apply to graduates who have only obtained a Bachelors degree in Austria.

PLEASE NOTE: For graduates, there is no points system. The Red-White-Red Card comes with an entitlement to fixed-term settlement and work for the specified employer 

Red-White-Red Card plus for graduates
Graduates holding a Red-White-Red Card may apply for a Red-White-Red Card plus with unlimited labour market access if they were employed in accordance with the related criteria for at least ten months within the preceding twelve months.

Graduates from Croatia
Graduates from Croatia have a right of settlement, but no unlimited access to the labour market.

Instead of a Red-White-Red Card, they are issued an employment permit without labour market test if they fulfil the criteria for the Red-White-Red Card. After a year of continuous employment under an employment permit, they will be given unlimited labour market access which has to be confirmed by the AMS.

Family reunification
Third-country nationals are individuals who are neither EEA- nor Swiss citizens. Third-country nationals family members who intend to reside or settle in Austria for a period of more than six months require a residence title (permission to stay for more than six months) corresponding to their residence purpose. 
For stays of up to six months no residence title shall be granted. Instead, a visa must be applied for if necessary.

Who is a family member?
Family members in the context of the Settlement and Residence Act are

• spouses
• registered partners and
• unmarried minors including adoptive and step children 

Spouses and registered partners must be 21 years of age or older when applying.

Which residence title will be granted to family members?
“Red-White-Red Card plus“
Family members of 

• holders of a “Red-White-Red Card“ or a “EU Blue Card"
• third-country nationals with a long-term residence title in Austria 

shall obtain the residence title “Red-White-Red Card plus“, provided they meet the general granting requirements.
The “Red-White-Red Card plus” grants its holders free access to the labour market. According to the Act Governing the Employment of Foreign Nationals no further permissions are required for any employed activity. 

“Family Member”
Family members of Austrian nationals shall obtain the residence title “Family Member”, provided they meet the general granting requirements.

“Settlement Permit – Dependant”
Other dependants of Austrian nationals shall obtain the residence title “Settlement Permit - Dependant”, if the general granting requirements are met and the sponsor to whom the third-country national refers in his/her application has issued a liability declaration.

Other dependants are:

• Relatives, also of spouses or registered partners in direct ascending line, if they receive actual maintenance
• Life partners providing evidence of a long-term relationship in their country of origin and receiving actual maintenance
• Other relatives under certain circumstances

PLEASE NOTE: There is no quota regarding residence titles issued to family members of Red-White-Red Card holders, EU Blue Card holders or family members of Austrian citizens. The number of otherresidence titles being issued for family reunification every year is limited. The following persons must have a quota in the quota system:
- Family members of a third-country national who is the holder of a residence title “Long-term Resident – EU” or a “Red-White-Red Card Plus” (in certain specific cases) or any kind of settlement permit
- Family members of individuals who have been granted asylum

General granting requirements
The following requirements must be met for granting any residence title:

• Adequate means of subsistence:The third-country national must have a fixed and regular income enabling him/her to meet his/her livelihood without resorting to welfare aid from local authorities.
  The income needs to be equal to or exceed the standard income rate. In 2017, this standard income rate amounted to € 889.84 for singles, € 1,334.17 for married couples and an additional € 137.30 for each child.
• Health insurance coverage: The third-country national must have health insurance coverage, providing benefits in Austria and covering all risks. Family members of “Red-White-Red Card” holders, “EU Blue Card” holders or family members of Austrian citizens are usually covered by their sponsors health insurance (co-insurance).  
• Adequate accommodation according to local standards:The third-country national must provide evidence of a legal title to an accommodation (e.g. by providing a lease contract), considered adequate for his/her family size according to local standards.

Providing evidence of German language skills (“German prior to immigration”)
Third-country nationals have to provide evidence of German language skills on A1 level according to the Common European Framework of Reference for Languages, when first applying for one of the following residence titles:

• “Red-White-Red Card plus“
• “Family Member”
• “Settlement Permit – Dependant”
• “Settlement Permit”
• “Settlement Permit – Gainful Employment Excepted” 

Only basic German language skills at beginner level are required. 

Competent authority
Competent first instance authorities shall be the local Provincial Governors Office or the duly authorised district administration bodies (District or Municipal Administrative Authorities). Local competence is governed by the (intended) domicile of the third-country national concerned.

Any complaints against decisions by the competent first instance authorities shall be handled by the locally competent Provincial Administrative Court. The authority shall decide on applications and complaints without undue delay, but not later than within six months after receipt.

Filing an application
As a matter of principle, first applications for residence titles shall be filed with the competent Austrian consular representation (embassy or specific consulates) abroad. Local competence of the consular representation depends on the applicants domicile. 

The consular representation abroad shall examine the application for completeness and correctness and then forward it to the competent authorities in Austria.

The following family members are entitled to file their application in Austria:

• Family members of Austrian nationals after lawful entry and during their lawful residence
• Children within six months after birth, if the mother holds a valid residence title
• Family members entitled to enter without a visa, during their permitted stay without a visa

PLEASE NOTE: An application filed in Austria shall not grant a right of residence to applicant beyond the time he/she is allowed to stay with or without a visa. When the time allowed to stay with or without a visa has expired he/she is required to depart and must await proceedings abroad.

Scope of residence titles and validity
The residence titles “Red-White-Red Card Plus” and “Family Member” allow time-limited settlement and entitle the holder to unrestricted access to the labour market. 

Required documents
Valid travel document. This requirement is waived in the case of first application of a child within six months after birth, if the child does not yet have a valid travel document.

• Birth certificate or similar document (only with first applications)
• Current photo of applicant
• If applicable
  - Marriage certificate
  - Divorce certificate
  - Certificate of registered partnership
  - Certificate of dissolution of a registered partnership
  - Adoption papers
  - Evidence or certificate concerning the family relationship

• Evidence of a legal title to an accommodation according to local standards, including lease or sublease contracts, preliminary property contracts or ownership evidence;
• Evidence of health insurance protection covering all risks and providing benefits in Austria, including submission of the corresponding insurance policy, unless compulsory insurance coverage exists or will exist;
• Evidence of means of secure subsistence (pay slip, pay certificate, employment contracts, certificates of state pension, pension insurance or other insurance benefits, evidence of adequate amounts of invested capital or owned assets); 
  Please note: Evidence of social benefits which are only due when the residence title is granted, including welfare aid and differential allowances, are not permissible.
• Evidence that sponsor holds the required residence title;
• Evidence of German language skills

Other forms of settlement
Third-country nationals are individuals who are neither EEA- nor Swiss citizens. If they intend to reside or settle in Austria for a period of more than six months they require a residence title (permission to stay for more than six months) corresponding to their residence purpose.
For stays of up to six months no residence title shall be granted. Instead, a visa must be applied for if necessary.

"Settlement Permit - Gainful Employment Excepted"
Third-country nationals wishing to settle in Austria without gainful employment (e.g. pensioners, financially independent individuals) may obtain a residence title “Settlement Permit – Gainful Employment Excepted“.

This residence title may be granted to third-country nationals, if: 

• They fulfil the general requirements for granting such an entitlement.
• A quota under the quota system is available (only a limited number of settlement permits can be granted each year).
• They have a regular monthly income (e.g. Austrian or foreign pensions, profits from enterprises abroad, income from assets, savings or company shares) equalling twice the amount of the standard rates of the General Social Insurance Act (ASVG).

General requirements for granting a residence title
The following requirements must be met for any residence title to be granted:

• Adequate means of subsistence: The third-country national must have a fixed and regular own income enabling him/her to meet his/her livelihood without resorting to welfare aid from local authorities (see standard rates above)
• Health insurance coverage: The third-country national must have health insurance coverage, providing benefits in Austria and covering all risks.
• Adequate accommodation according to local standards: The third-country national must provide evidence of a legal title to an accommodation (e.g. by presenting a lease contract) considered adequate for his/her family size according to local standards.

Providing evidence of German language skills (“German prior to immigration”)
Third-country nationals have to provide evidence of German language skills at A1 level according to the Common European Framework of Reference for Languages, when first applying for a residence title “Settlement permit – gainful employment excluded”. Only basic German language skills at beginner level are required.

Evidence of German language skills may be provided by:

• A generally acknowledged language diploma or a course certificate from one of the following institutions:
  - Austrian Language Diploma German 
  - Goethe-Institut e.V. 
  - Telc GmbH
  - Austrian Integration Fund (ÖIF)

Further institutions may be announced by way of publication on the official notice board of the competent Austrian representation (embassy, consulate) abroad. 

• The fulfilment of the requirements of Modules 1 or 2 of the Integration Agreement (i.e. German language skills at A2 or B1 level) also rates as evidence of adequate German language skills.

PLEASE NOTE: The language diploma or course certificate must not be older than one year when being submitted.

Evidence of adequate German language skills does not need to be provided by

• Persons who have not completed 14 years of age when applying
• Persons who cannot reasonably be expected to provide such evidence on grounds of their physical or mental health condition; in such a case, the third-country national must provide a medical report issued by a public health officer or by a doctor appointed by an Austrian consular representation.

PLEASE NOTE: Persons whose proceedings for obtaining a residence title started on or before 30 June 2011 do not need to provide evidence of German language skills before immigration. 

Scope of residence titles and validity
The residence title “Settlement Permit – Gainful Employment Excepted” allows time-limited settlement without access to the labour market and shall be issued for the duration of one year.

The residence title shall be issued for a duration of three years if 

• the third-country national has completed Module 1 of the Integration Agreement (i.e. German language skills at A2 level according to the Common European Framework of Reference for Languages) and 
• has lawfully resided in Austria without interruption during the previous two years.

After five years of lawful residence without interruption, a residence title “Long-term Residence – EU” may be applied for 

• if the general requirements have been met and
• Module 2 of the Integration Agreement has been completed (i.e. German language skills at B1 level according to the Common European Framework of Reference for Languages).

Competent authority
Competent first instance authorities shall be the local Provincial Governors Office or the duly authorised district administration bodies (District or Municipal Administrative Authorities). Local competence is governed by the (intended) domicile of the third-country national concerned.

"Long-term Resident - EU"
The residence title “Long-term Resident – EU” may be granted to third-country nationals, if they

• have been entitled to reside in Austria during the last five years without interruption, 
• have fulfilled the general requirements and 
• have completed Module 2 of the Integration Agreement (i.e. German language skills at B1 level according to the Common European Framework of Reference for Languages).

General granting requirements
The following requirements must be met for a residence title “Long-term Resident – EC” to be granted: 

• Adequate means of subsistence:
  The third-country national must have a fixed and regular income enabling him/her to meet his/her livelihood without resorting to welfare aid from local authorities.
  The income needs to be equal to or exceed the standard income rate. In 2017, this standard income rate amounts to €898.84 for singles, €1,334.17 for married couples and an additional €137.30 for each child.
• Health insurance coverage: The third-country national must have health insurance coverage, providing benefits in Austria and covering all risks.
• Adequate accommodation according to local standards: The third-country national must provide evidence of a legal title to an accommodation (e.g. by providing a lease contract), considered adequate for his/her family size according to local standards.

Module 2 of the Integration Agreement
Module 2 of the Integration Agreement is intended to provide German language skills for in-depth autonomous language use (i.e. German language skills at B1 level according to the Common European Framework of Reference for Languages).

Module 2 is deemed to be completed if one of the following conditions has been fulfilled:

• Generally acknowledged evidence of adequate German language skills provided by certificates upon successfully passing a B1 level test according to the Common European Framework of Reference for Languages, in particular from one of the following institutions:
  - Austrian Integration Fund (ÖIF)
  - Austrian Language Diploma German
  - Goethe-Institut e.V.
  - Telc GmbH
• Being a minor and attending primary school (Volksschule) within the scope of compulsory education;
• Being a minor attending secondary school (e.g. Hauptschule, AHS) and having successfully completed German classes;
• Evidence of having attended a compulsory school in Austria for a minimum of five years and having successfully completed German classes or having successfully completed German classes on a 9th grade level;
• Evidence of having successfully completed German classes at a school abroad, where German is taught at least at a 9th grade level of an Austrian compulsory school; 
  or
• Passing a final apprenticeship examination according to the Vocational Training Act.

The following persons do not need to complete Module 2 of the Integration Agreement to be able to obtain a residence title “Long-term resident – EU”: 

• Third-country minors who are not yet subject to compulsory education when applying. Compulsory general education starts on 1 September of the year following the applicants 6th birthday.
• Third-country nationals in a permanently bad physical or mental health condition; when claiming a permanently bad health condition, a medical report issued by a public health officer has to be provided.

Scope of residence title and validity
The residence title “Long-term Resident - EU” allows long-term settlement and free access to the labour market and shall be issued for the duration of five years.

• Evidence of completion of Module 2 of the Integration Agreement and
• Evidence of lawful residence in Austria during the last five years without interruption. 

Поездка с детьми
В случае путешествия с детьми на них предоставляется такой же набор документов, что и для взрослых (включая фотографию установленного образца).

Необходимые документы:
-оригинал и копия свидетельства о рождении ребенка, не достигшего 18 лет (даже при наличии собственного внутреннего и загранпаспорта);

-справка из учебного заведения;

-спонсорское письмо от одного из родителей;

-если ребенок, не достигший 18 лет, путешествует в сопровождении одного из родителей либо третьего лица, необходимо предоставить нотариально заверенную доверенность/согласие на вывоз ребенка от остающегося/остающихся родителя/родителей и ее копию, копию страницы паспорта с данными доверителя;
-медицинская страховка.

В случае если один из родителей получил визу ранее, нужно приложить копию этой визы и копию первой страницы загранпаспорта с личными данными.
На детей, вписанных в паспорт родителя, должна в обязательном порядке быть вклеена фотография. На детей, вписанных в загранпаспорт родителя, в этот паспорт вклеивается отдельная виза. Дети, достигшие 14 лет, должны иметь свой загранпаспорт.

Срок оформления визы в Австрию
Документы на оформление визы можно подавать на ранее чем за 3 месяца до начала поездки.

Стандартный срок оформления виз от 5 до 6 дней.
Срок оформления срочных виз 3 дня.
Срок оформления транзитных виз - 5 рабочих дней.

Срок действия виз при первом обращении 3-6 месяцев.
При наличии ранее выданных шенгенских виз и при условии соблюдения визового режима, визу можно запрашивать - на 1-3 года, и далее на 5 лет.
Срок пребывания в Шенгене не может превышать 90 дней в течение каждых 180 дней

Требования к фотографиям
-размер фотографии 35х45 мм;



-фотография должна быть выполнена не ранее, чем за 6 месяцев до подачи заявления;



-четкое цветное изображение на светлом фоне;



-изображение должно занимать примерно 70%-80% снимка, расстояние от подбородка до макушки - 30 мм;



-на фотографии не должно быть овалов, рамок и уголков;



-на фотографии заявитель должен быть изображен без очков/солнцезащитных очков, шляп и платков, за исключением случаев, когда это необходимо по религиозным либо медицинским соображениям.  

Важно! Консульство оставляет за собой право потребовать дополнительные документы.

Продление визы в Австрии невозможно. 

Кроме граждан РФ, визовый отдел Посольства Австрии в Москве выдает визы гражданам Армении, Беларусии и Узбекистана, а также гражданам третьих стран, законно проживающим в одном из этих государств.

Для иностранных граждан, проживающих в Российской Федерации:
Иностранные граждане должны предоставить документ, подтверждающий их право на проживание в Российской Федерации (вид на жительство, долгосрочная виза или регистрация ФМС по месту пребывания/проживания: оригинал и копия). Данный документ должен быть действителен в течение минимум 3 месяцев после запланированного возвращения из Шенгенской зоны, или необходимо предоставить документ, подтверждающий, что нерезидент подал запрос на продление срока действия легального нахождения в России. 

БИОМЕТРИЧЕСКИЕ ДАННЫЕ
Для оформления виз получаемых впервые начиная с 14 сентября 2015 года необходимо личное присутствие заявителя в консульском учреждении или визовом центре для предоставления биометрических данных (цифровое фото и отпечатки пальцев), которые предоставляются не чаще чем 1 раз в 5 лет. 
Лица, которые получили визу после 14 сентября 2014 года и срок действия этой визы окончился, могут оформлять визы без личного присутствия в консульстве или визовом центре.

В случае необходимости сдача биометрических данных может быть проведена по месту жительства или работы заявителя (представитель выезжает на место со сканнером для снятия отпечатков пальцев). 

При оформлении виз, заявитель после подачи всех документов в нашу компанию, в течение 1-2 дней получает письмо - подтверждение о передаче документов в консульство и записи его на сдачу биометрических данных. На сдачу биометрических данных, заявитель приходит лично, только с письмом подтверждением и общегражданским паспортом (дети до 14 лет со свидетельством о рождении). Никаких документов предъявлять не требуется, все документы подтверждающие цель туристической или деловой поездки, включая заграничный паспорт, на момент сдачи биометрических данных уже находятся в консульстве или визовом центре.

В случаи если биометрические данные были сданы после 14 сентября 2015 года, но в визе было отказано или биометрические данные сдавались для оформления визы D, заявители обязаны повторно сдать биометрические данные.

Уважаемые заявители и представители туристических агентств, в настоящее время мы НЕ принимаем документы на оформление виз для уроженцев республик Северного Кавказа: Дагестан, Карачаево-Черкесия, Кабардино-Балкария, Северная Осетия, Ингушетия, Чечня, а также для граждан Южной Осетии и Республики Абхазия в связи с участившимися случаями без мотивных отказов в выдаче виз вышеуказанным категориям граждан.  

Для оформления виз гражданам СНГ (Азербайджана, Армении, Белоруссии, Казахстана, Киргизии, Таджикистана, Узбекистана, Украины) в консульском округе России (Москве), необходимо подтверждение легального проживания (вид на жительство, разрешение на временное проживание, регистрация по месту пребывания)  и наличия средств для поездки (подтверждение места работы, разрешение на работу, выписка из банка об остатке средств на счете).

При оформлении виз в консульском округе России (Москве) Граждане Белоруссии и Казахстана освобождены от необходимости оформления вида на жительство, разрешения на временное проживание и разрешения на работу в России. 
При оформлении виз в консульском округе России (Москве) Граждане СНГ имеющие разрешение на временное проживание или вид на жительство освобождены от необходимости оформления разрешения на работу.

Граждане СНГ при оформлении виз в Москве и отсутствии места работы (разрешения на работу) или отсутствия подтверждения наличия средств в банке вправе предоставить письмо о спонсорстве с приложением копии паспорта спонсора, копии свидетельства подтверждающего отношение к заявителю, подтверждение места работы и выписки о наличии средств в банке. Спонсорами по отношению друг к другу могут быть только родители, дети, бабушки и дедушки, муж и жена. Спонсорство иных лиц правового значения не имеет.

Граждане СНГ (Азербайджана, Армении, Белоруссии, Казахстана, Киргизии, Молдавии, Таджикистана, Туркменистана, Узбекистана, Украины), граждане Грузии, Литвы, Латвии, Эстонии в случае отсутствия консульства на их территории вправе оформить визу в консульстве в Москве без необходимости подтверждения легального пребывания на территории России.
